  • Tenders are invited for Consultant - Assessment of the ZPCS compliance with the UN Standard Minimum Rules for the Treatment of Prisoners – The Nelson Mandela Rules (NMRs). Background Individual Consultant - Assessment of the Zimbabwe Prisons and Correctional Service (ZPCS) compliance with the United Nations Standard Minimum Rules for the Treatment of Prisoners – The Nelson Mandela Rules (NMRs). More than 10.35 million men, women and children are held in prisons globally; these include pre-trial detainees/remand prisoners and those who have been convicted and sentenced1. Prisoners are vulnerable populations, and are often subjected to inhumane treatment. On 17 December 2015, the General Assembly (GA) adopted the revised United Nations Standard Minimum Rules for the Treatment of Prisoners (The Nelson Mandela Rules) which sets out the minimum standards for the treatment of prisoners. UNODC is the custodian of the Nelson Mandela Rules (NMRs), and assists member states in developing and strengthening penitentiary legislations, procedures, policies and practices that are in line with the rules. It is against this background that UNODC seeks to recruit a national consultant to support ZPCS in conducting an assessment for compliance with the NMRs. The assessment will cover all the NMR rules but will have a special focus on Healthcare services. Duties and Responsibilities Purpose of the Consultancy: Under the overall supervision of the Regional Programme Coordinator, direct supervision of the National Project Coordinator and working closely with ZPCS focal person, the consultant will conduct an assessment of the ZPCS compliance with the NMRs. Upon completion of the assessment, the consultant will convene a meeting with ZPCS and all stakeholders to share the findings and recommendations; and further support ZPCS with the development of the action plans to address any identified compliance gaps. Duties and Responsibilities: In close consultation with ZPCS and UNODC the consultant will be expected to: · Submit and present the consultancy inception report; which should elucidate the understanding of the assignment, outlining how the assessment will be carried out, the methodological approach (as per UNODC “Assessing compliance with NMRs a checklist) including work plan and time frames; · Undertake a desk review of national laws, ZPCS Act, regulations, related policies, guidelines and other relevant documents as related to the treatment of inmates to assess the compliance with the UN policy and technical guides; · Review and adapt the assessment instruments as per UNODC NMRs compliance assessment checklist; · Convene a planning meeting with UNODC and ZPCS senior management to discuss and reach consensus on the methodological approach and the proposed instruments; · Conduct the NMR compliance assessment for 10 prisons; · Analyze data and compile the assessment report, with clearly formulated recommendations on how gaps can be addressed by ZPCS; · Convene a meeting with UNODC, ZPCS and related partners to share the assessment findings, and further support ZPCS with the development of the action plans to address identified compliance gaps; · Finalize and submit an edited final assessment report to UNODC/ZPCS for approval. Deliverables and timelines: Implementation of activities as set out in this contract will be as proposed in the table below: Item # Product Deliverable Timeline 1 Draft, submit and present the consultancy inception report, with a comprehensive budget and costed work plan to UNODC. 1 working day 2 Undertake a desk review of national laws, ZPCS Act, regulations, related policies, guidelines, reports of studies conducted by UNODC in prisons and other relevant documents as related to the treatment of inmates. 1 working day 3 Review and adapt assessment instruments as per UNODC NMRs compliance assessment checklist. 2 working days 4 Convene a planning meeting with UNODC and ZPCS senior management to discuss and reach consensus on the methodological approach and the proposed instruments. 1 working day 5 Conduct the NMR assessment 30 working days 6 Analyze data and compile the assessment report, with clearly formulated recommendations on how gaps can be addressed by the Correctional authority. 7 working days 7 Convene a meeting with UNODC and ZPCS to share the assessment findings, and further support ZPCS with the development of the action plan to address identified compliance gaps. 1 working day 8 Finalize and submit an edited final assessment report to ZPCS/UNODC for approval. 5 working days TOTAL DAYS TO COMPLETE THE ASSIGNMENT 48 working days Remuneration: The consultant will receive remuneration in lump-sum relevant to his/her qualification and in line with UN financial rules and regulations. Payment will be released in two separate installments subsequent to receipt and approval of deliverables by UNODC as follows: · The first instalment, amounting to 40% of the total cost of the contract will be released upon UNODC receipt and approval of the detailed inception report with a comprehensive budget and costed work plan; · Another instalment amounting to 60% of the total cost of the contract will be released following UNODC receipt and approval of the final comprehensive edited assessment report; Note: Payment is subject to approval by UNODC of all deliverables. Approval will only be granted based on quality assessment of deliverables submitted. A turn-around time of 5 working days should be factored in, for comments from ZPCS and UNODC. Competencies Core competencies: · Demonstrates integrity by modelling the UN’s values and ethical standards; · Advocates and promotes the vision, mission, and strategic goals of UNDP; · Displays cultural, gender, religion, race, nationality and age sensitivity and adaptability; · Treats all people fairly without favoritism. Functional competencies: · Excellent reporting and communication skills; · Strong writing skills; · Strong interpersonal and networking skills. Required Skills and Experience Education: · Advanced University Degree in Public Health, Biostatistics, Law, Social Sciences, or any related discipline. Experience: · At least five years of work experience in criminal justice or public health – related areas, preferably in prison and correctional reforms; · Work experience in research in criminal justice, public health or related issues; · Good domain and understanding of UN standards and Norms related to treatment of prisoners; · Good domain and understanding of NMRs; · Knowledge of national laws, and policies on the treatment of inmates; · Knowledge of the ZPCS ACT; · Advanced knowledge of MS Office package (MS Word, MS Excel, MS PowerPoint required. Language: · Proficiency in written and spoken English, including the ability to write reports at a professional level. The award of the contract will be made to the Consultant whose offer has been evaluated and determined as: Responsive/compliant/acceptable; and having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the Terms of Reference.
